自然保护区立法的利益博弈

Game of Interests on Legislation of Natural Reserves

摘要: 通过对我国自然保护区设立后运行中出现的问题进行利益分析，指出目前存在的自然保护区保护不力问题不仅仅是因为法律的位阶低等因素导致的，而是保护区的立法未能较好地协调其背后的各种利益关系，没能有效地重新分配或确认这些利益关系。最后，提出了在兼顾环境利益、国家利益、地方利益与社区居民利益的基础上，进行制度构建的必要性。

Abstract: Through analyzing the issues appeared after the establishments of natural reserves, this paper points out that the natural reserves do not work well not only because of the lower rank of regulations in Chinese legal system, but also the legislations can not successfully coordinate all kinds of interests behind the natural reserves and can not efficiently allocate or confirm the interests. The author indicates that it is necessary to build reasonable rules and regulations which can justly redistributes all kinds of interests based on giving consideration of environmental, national, local and community interests.
